Welcome to Guest Guru! These Legal Terms constitute a legally binding agreement (“Agreement”) made between you (“User” or “Client”) and Chestnut Capital Group LLC DBA Guest Guru (“Company,” “we,” “us,” “our”), concerning your access to and use of our services, as well as any other related products and services that refer or link to these Legal Terms (collectively, the “Services”).
By using the Services, you agree that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. Description of Our Services
Guest Guru is a professional property management company specializing in short-term rental (STR) properties. We provide end-to-end services for real estate investors, including dynamic pricing, guest communication, marketing, and maintenance, to help them maximize their rental income and create a hands-off ownership experience.
2. Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”). The Content and Marks are protected by copyright and trademark laws and treaties around the world.
The Content and Marks are provided to you “AS IS” for your personal, non-commercial use or internal business purposes only. Any breach of these Intellectual Property Rights will be a material breach of our Legal Terms.
3. Prohibited Activities
As a user of the Services, you agree not to access or use the Services for any purpose other than that for which we make them available. You agree not to engage in the following prohibited activities:
- Systematically retrieve data from the Services to create a compilation or directory without our written permission.
- Trick, defraud, or mislead us and other users.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Disparage, tarnish, or otherwise harm us and/or the Services.
- Use any information obtained from the Services to harass, abuse, or harm another person.
- Make improper use of our support services or submit false reports of abuse or misconduct.
- Engage in any unauthorized use of the system, such as using scripts to send messages, or using any data mining, robots, or similar tools.
- Use the Services as part of any effort to compete with us or for any revenue-generating endeavor or commercial enterprise.
4. Dispute Resolution
Any dispute between you and Guest Guru will be resolved through a two-step process:
- Informal Negotiations. The parties will first attempt to negotiate any dispute informally for at least 30 days before initiating any formal proceedings.
- Binding Arbitration. If the parties fail to resolve the dispute through informal negotiations, the dispute will be submitted to binding arbitration in Louisville,KY 40241.
If a dispute proceeds in court rather than arbitration, the litigation will take place in Kentucky.
5. Limitation of Liability
To the fullest extent permitted by law, Guest Guru’s total liability for any claim arising out of or relating to your use of our services shall be limited to the amount you have paid to Guest Guru in the 12 months preceding the claim, or a maximum of $10,000, whichever is less.
You agree that any cause of action arising from or related to the Services must commence within two (2) years after the cause of action accrues. Otherwise, such a cause of action is permanently barred.
6. Governing Law
These Legal Terms and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law provisions.
